Terms of Service

1. What FairShake is (and isn't)

FairShake analyzes marketplace listings and produces buy / skip / negotiate verdicts based on real sold comps, photo audits, and seller heuristics. Our verdicts are informational. They are not financial, legal, or appraisal advice. You are responsible for your own purchase, sale, and negotiation decisions.

2. Public beta

FairShake is currently in public beta. That means:

• The service is provided free of charge during this period.
• The service may have bugs, downtime, incorrect verdicts, or missing features.
• Features, pricing, and policies may change without notice during beta.
• Per-user daily and monthly usage caps apply.

3. Paid plans and credits

During the public beta, all use is free and this section is dormant. When paid plans launch, the following applies:

• Subscriptions. Premium and Reseller Pro are offered as monthly or annual subscriptions. Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel anytime from your Account page; cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by law, we don't prorate or refund partial periods.
• Credit packs. Credit packs are a one-time purchase, not a subscription. Credits never expire and stay on your account until used. Each credit covers one successful analysis; analyses that fail are not charged. Once any credit from a pack has been used, that pack is non-refundable. If you haven't used any credits from a pack, contact us within 14 days of purchase for a full refund. Credits have no cash value and are non-transferable.
• Price changes. We may change prices. Changes to subscription prices take effect at your next renewal, and we'll email you before they do.

4. Acceptable use

You may use FairShake to analyze listings you are personally interested in buying or selling. You may use the bulk-scan feature on search results pages you are personally browsing.

You may NOT:

• Resell, redistribute, or republish FairShake outputs as your own product or content.
• Use the service to facilitate fraud, harassment, or any illegal activity.
• Run automated scrapers against our endpoints beyond normal in-browser use.
• Attempt to bypass per-user caps, the daily spend cap, or rate limits.
• Reverse-engineer, decompile, or otherwise attempt to extract our pipeline.

5. Your account

You're responsible for keeping your sign-in email secure. Since FairShake uses magic-link sign-in, anyone with access to your email can sign in as you. If your email is compromised, sign out of all sessions (Account page) and consider deleting your FairShake account.

6. Content you submit

When you submit a listing URL or paste listing details, you confirm you have the right to do so (i.e. the listing is publicly accessible, or you're the seller). We do not claim ownership of listings you submit. We may cache anonymized pricing data we look up while processing them.

7. No warranty

The service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that:

• Verdicts are accurate, complete, or applicable to your specific situation.
• The service will be uninterrupted, secure, or error-free.
• The service will be suitable for any particular purpose.

8. Limitation of liability

To the maximum extent permitted by law, FairShake (and its operators) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising from your use of the service. In any case, our total liability shall not exceed the amount you've paid us in the 12 months preceding the claim — which, during the free beta, is zero.

9. We can revoke access

We may suspend or terminate your access at any time, with or without notice, if we believe you've violated these terms, are abusing the service, or for any other reason. You can also stop using FairShake at any time by deleting your account.

10. Changes to these terms

We may update these terms during beta. Material changes will be communicated via email to signed-in users. Continued use after a change constitutes acceptance.

11. Governing law

These terms are governed by the laws of the United States. Disputes shall be resolved in the courts of the operator's home jurisdiction.
